1. Agreement to Terms

Welcome to Resume Roast. By accessing or using our website, services, or creating an account, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree with any part of these terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

Resume Roast provides AI-powered resume analysis, suggestions, and improvement tools designed to help job seekers enhance their resumes. The Service is provided "as is" and is intended for informational and educational purposes only.

3. Use of Service

You agree to use the Service only for lawful purposes and in accordance with these Terms. You are responsible for all activity that occurs under your account.

Prohibited Activities:

• Scraping and Automation: You may not use any robot, spider, scraper, or other automated means to access the Service for any purpose without our express written permission.
• Reverse Engineering: You may not attempt to reverse engineer, decompile, or disassemble any aspect of the Service, including our AI models and algorithms.
• Abuse: You may not interfere with or disrupt the integrity or performance of the Service, including spamming, hacking, or overwhelming our infrastructure.
• Malicious Content: You may not upload or transmit any content that contains viruses, malware, or any other harmful code.
• Illegal Use: You may not use the Service for any illegal or unauthorized purpose, or to solicit the performance of any illegal activity.

To access certain features of the Service, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

"User Content" refers to any text, files, resumes, or other materials that you upload, submit, or transmit to the Service.

• Ownership: You retain full ownership of your User Content. We do not claim any ownership rights over your resumes or personal data.
• License to Process: By uploading User Content, you grant Resume Roast a worldwide, non-exclusive, royalty-free license to use, reproduce, process, and display your User Content solely for the purpose of providing the Service to you (e.g., analyzing your resume).
• Responsibility: You are solely responsible for your User Content and the consequences of posting or publishing it. You represent that you own or have the necessary rights to your User Content.

6. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Resume Roast and its licensors. The Service is protected by copyright, trademark, and other laws of both Mexico and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Resume Roast.

Certain aspects of the Service may be provided for a fee or other charge. If you elect to use paid aspects of the Service, you agree to the pricing and payment terms as we may update them from time to time.

• Payment Processing: We use third-party payment processors (e.g., Stripe) to bill you. The processing of payments will be subject to the terms, conditions, and privacy policies of the Payment Processor in addition to these Terms.
• Subscriptions: If you purchase a subscription, it will automatically renew unless cancelled. You may cancel your subscription at any time through your account settings.
• Refunds: Refunds are handled on a case-by-case basis and are generally not provided for partial subscription periods, except as required by applicable law.

We strive to keep the Service up and running; however, all online services suffer occasional disruptions and outages. We are not liable for any disruption or loss you may suffer as a result. We may update, modify, or discontinue any part of the Service at any time, with or without notice.

10. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or delete your account through the settings.

To the maximum extent permitted by applicable law, the Service is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, whether express or implied.

In no event shall Resume Roast, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.

12. Indemnification

You agree to defend, indemnify, and hold harmless Resume Roast and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; b) a breach of these Terms, or c) Content posted on the Service.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of Mexico, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

14. Dispute Resolution

Any dispute arising out of or relating to these Terms or the Service shall be resolved in the federal or state courts located in Mexico. You consent to the personal jurisdiction and venue of such courts.

15. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
